जिला सिरमौर स्थित प्रदेश की आदर्श केन्द्रीय कारागार नाहन से आजीवन कारावास भुगत रहे चार कैदियों को जेल से रिहा कर दिया गया है। जेल विभाग से मिली आधिकारिक पुष्टि से पता चला है कि सरकार की प्री मैच्योर रिलीज़ के तहत 6 आजीवन कारावासियों की अनुशंसा जेल विभाग से स्टेट सेंटेंस रिव्यू बोर्ड को भेजी गई थी। बता दें कि यह अनुशंसा सज़ा के 14 वर्ष पूरे किए जाने के बाद ही भेजी जाती है। यह अनुशंसा उन्हीं कैदियों की भेजी जाती है जिनका जेल में बिताया गया समय साफ सुथरे आचरण वाला रहा हो। जिला सिरमौर स्थित प्रदेश की आदर्श केंद्रीय कारागार नाहन से आजीवन कारावास भुगत रहे ऐसे 6 कैदियों की रिहाई की संस्तुति सरकार को भेजी गई थी जिनका गुड कंडक्ट के साथ सज़ा के चौदह वर्ष जेल में पूरे हो चुके थे।
इन 6 कैदियों में से चार कैदियों की तमाम औपचारिकताओं के पूर्ण होने के बाद उन्हें कारागार से मुक्त कर दिया गया है। जबकि छत्तीसगढ़ और अमृतसर के दो कैदियों कि उनके क्षेत्र के कंसर्न डीसी से श्योरिटी बॉन्ड की रिपोर्ट अभी तक जेल विभाग के पास नहीं पहुंची है। अब जैसे ही कंसर्न डीसी की रिपोर्ट आती है, उसके बाद बाकी दो कैदियों की भी रिहाई की जाएगी। प्राप्त जानकारी के अनुसार जिन चार आजीवन कारावास भुगत रहे कैदियों की रिहाई के आदेश आए हैं उनमें से एक सिरमौर, बिहार, हरियाणा और हिमाचल प्रदेश के ऊना जिला का है। जेल विभाग के द्वारा छः और ऐसे कैदियों की रिहाई की संस्तुति प्रीमैच्योर रिलीज के लिए तैयार की गई है जो अपनी सज़ा के चौदह वर्ष लगभग पूरे कर चुके हैं। आजीवन कारावास में प्री मैच्योर रिलीज़ के लिए बेहतर आचरण वाले कैदियों की स्टेट सेंटेंस रिव्यू बोर्ड के लिए जेल विभाग के द्वारा रिपोर्ट तैयार कर एडीजी जेल को भेजी जाती है।
एडीजी जेल इस रिपोर्ट को सेक्रेटरी होम की अध्यक्षता में बनाई गई स्टेट सेंटेंस रिव्यू बोर्ड के लिए भेजते हैं। इस बोर्ड में मंजूरी के बाद रिपोर्ट को कैबिनेट में भेजा जाता है। सरकार द्वारा कैबिनेट में रखे गए प्रस्ताव को मंजूरी मिलने के बाद आजीवन कारावास वाले कैदियों की रिहाई के आदेश जारी किए जाते हैं। इस नई कंडीशन में कैदी के द्वारा दस हज़ार का श्योरिटी बांड कंसर्न डीसी के पास जमा कराना होता है। जैसे ही डीसी की रिपोर्ट जेल विभाग को मिलती है उसके बाद ही कैदी की रिहाई संभव हो पाती है। सुप्रीम कोर्ट ने समय से पहले रिहाई (प्री-मैच्योर रिलीज़) के संबंध में स्पष्ट दिशानिर्देश दिए हैं। सर्वोच्च न्यायालय ने कहा है कि राज्य सरकारों को ऐसे मामलों में मानवतावादी दृष्टिकोण,अपराध की गंभीरता, जेल में कैदी के आचरण और समाज पर पड़ने वाले प्रभाव जैसे सभी कारकों पर विचार करना चाहिए। राज्य सरकारें दंड प्रक्रिया संहिता (CrPC) की धारा 432 के तहत सज़ा माफ़ कर सकती हैं। खबर की पुष्टि करते हुए सुपरिंटेंडेंट सेंट्रल जेल नाहन, भानुप्रकाश वर्मा ने बताया कि हत्या के आरोप में आजीवन सज़ा काट रहे चार कैदियों को तमाम औपचारिकताओं के बाद रिहा कर दिया गया है।

Four prisoners serving life sentences have been released from the ideal central jail in Nahan, located in Sirmaur district. Official confirmation from the jail department revealed that the recommendations for the premature release of six life-term prisoners were sent from the jail department to the State Sentence Review Board under the government’s premature release policy. It should be noted that these recommendations are only sent after the completion of 14 years of the sentence. These recommendations are only sent for prisoners who have maintained good conduct during their time in jail. Recommendations for the release of six such prisoners from the ideal central jail in Nahan, Sirmaur district, who had completed fourteen years of their sentence with good conduct, were sent to the government.
Of these six prisoners, four have been released from jail after all the formalities were completed. However, the reports regarding the surety bonds from the concerned Deputy Commissioners of Chhattisgarh and Amritsar for the other two prisoners have not yet reached the jail department. As soon as the reports from the concerned Deputy Commissioners are received, the remaining two prisoners will also be released. According to the information received, of the four prisoners serving life sentences whose release orders have been issued, one is from Sirmaur, one from Bihar, one from Haryana, and one from Una district in Himachal Pradesh. The jail department has also prepared recommendations for the premature release of six more prisoners who have completed approximately fourteen years of their sentences. For premature release in cases of life imprisonment, the jail department prepares a report for the State Sentence Review Board regarding prisoners with good conduct and sends it to the Additional Director General of Prisons.
The Additional Director General of Prisons sends this report to the State Sentence Review Board, headed by the Home Secretary. After approval by this board, the report is sent to the Cabinet. Once the proposal placed before the Cabinet by the government is approved, orders are issued for the release of prisoners serving life sentences. Under this new condition, the prisoner has to submit a surety bond of ten thousand rupees to the concerned Deputy Commissioner (DC). The prisoner’s release is only possible after the DC’s report is received by the jail department. The Supreme Court has given clear guidelines regarding premature release. The apex court has stated that state governments should consider all factors in such cases, including a humanitarian approach, the gravity of the crime, the prisoner’s conduct in jail, and the impact on society. State governments can remit sentences under Section 432 of the Code of Criminal Procedure (CrPC). Confirming the news, Superintendent of Central Jail Nahan, Bhanuprakash Verma, stated that four prisoners serving life sentences for murder have been released after completing all the formalities.
