हिमाचल प्रदेश हाईकोर्ट को एसएमसी शिक्षकों के नियमितिकरण मामले में सुनवाई हुई। यह शिक्षक 13- 14 साल से प्रदेश के विभिन्न स्कूलों में सेवाएं दे रहे हैं। इन्होंने अदालत से मांग की है कि जिस तरह से सरकार ने विद्या उपासक, पैरा टीचर और पीटीए शिक्षकों को नियमित किया है, उसी आधार पर एसएमसी शिक्षकों को भी नियमित किया जाए। अदालत को बताया कि इन शिक्षकों की नियुक्ति योग्यता के आधार पर की गई है और नियुक्तियों के समय पारदर्शिता बरती गई है। न्यायाधीश संदीप शर्मा की अदालत ने राज्य सरकार को आदेश दिए हैं कि महाधिवक्ता इस मामले में अगली सुनवाई पर अपना पक्ष अदालत के समक्ष रखें। सुनवाई के दौरान अदालत को बताया गया कि एसएमसी के लिए 5 फीसदी कोटा निर्धारित किया है।

प्रदेश में करीब 1800 एसएमसी शिक्षक कार्यरत हैं। प्रदेश सरकार ने 2012 के बाद शिक्षकों की कमी के चलते पहली से 12वीं तक बच्चों को पढ़ाने के लिए एसएमसी आधार पर अध्यापकों की नियुक्ति शुरू की। हिमाचल हाईकोर्ट की खंडपीठ ने एसएमसी शिक्षकों को हटाने के निर्देश दिए थे, लेकिन सरकार ने इस आदेश के खिलाफ सुप्रीम कोर्ट में एसएलपी दायर की थी। राज्य सरकार ने सुप्रीम कोर्ट में तर्क दिया था कि शिक्षकों के पद खाली होने की वजह से फौरी तौर पर एसएमसी शिक्षकों को भर्ती किया गया है, जिससे प्रदेश में शिक्षा के स्तर को बरकरार रखा जा सके। सरकार ने तर्क दिया था कि नियमित शिक्षकों की नियुक्ति होने तक यह शिक्षक अस्थायी तौर पर नियुक्त किए गए हैं। सुप्रीम कोर्ट की तीन जजों की बेंच ने 24 नवंबर 2020 को एसएलपी को स्वीकार करते हुए राज्य सरकार को शिक्षकों की नियुक्ति आरएंडपी के तहत करने के निर्देश दिए थे।

The Himachal Pradesh High Court heard the case of regularization of SMC teachers. These teachers have been serving in various schools of the state for 13-14 years. They have demanded from the court that the way the government has regularized Vidya Upasak, Para Teachers and PTA teachers, on the same basis SMC teachers should also be regularized. The court was told that these teachers have been appointed on the basis of merit and transparency has been maintained during the appointments. The court of Justice Sandeep Sharma has ordered the state government that the Advocate General should present his side before the court in the next hearing in this matter. During the hearing, the court was told that 5 percent quota has been fixed for SMC.

Approximately 1,800 SMC teachers are employed in the state. After 2012, the state government began recruiting teachers on the SMC basis to teach students from grades 1 to 12 due to a teacher shortage. A division bench of the Himachal High Court ordered the removal of SMC teachers, but the government filed a Special Power of Attorney (SLP) in the Supreme Court challenging this order. The state government argued in the Supreme Court that SMC teachers were recruited immediately due to vacant teaching positions, thus maintaining the quality of education in the state. The government argued that these teachers were appointed on a temporary basis until regular teachers were appointed. On November 24, 2020, a three-judge bench of the Supreme Court accepted the SLP and directed the state government to recruit teachers under the R&P (Right to Position) Act.
