हिमाचल प्रदेश हाईकोर्ट ने पुलिस कांस्टेबल भर्ती में पूर्व सैनिकों के लिए निर्धारित कटऑफ तिथि को अवैध करार देते हुए रद्द कर दिया है। सैनिक कल्याण विभाग की 21 फरवरी 2025 की अधिसूचना में अदालत से पूर्व सैनिकों की पात्रता तय करने के लिए सेवा मुक्ति की जो तिथि (13 दिसंबर 2022 से 13 दिसंबर 2024) निर्धारित की गई थी, उसे कोर्ट ने रद्द कर दिया है। न्यायाधीश ज्योत्सना रिवाल दुआ की एकल पीठ ने तीन सप्ताह के भीतर सेवा से मुक्त होने की नई वैध कट ऑफ तिथि तय करने के निर्देश दिए हैं। कोर्ट ने यह भी स्पष्ट किया है कि जब तक यह प्रक्रिया पूरी नहीं होती, तब तक पूर्व सैनिक श्रेणी का परिणाम घोषित नहीं किया जाएगा।

इस मामले की अगली सुनवाई 11 अगस्त को होगी। याचिकाकर्ताओं ने तर्क दिया कि 21 फरवरी की अधिसूचना में निर्धारित तिथि किसी कानून, नियम या मैन्युअल में उल्लेखित नहीं है और यह मनमानी प्रतीत होती है। पहले जारी अधिसूचना में 1 जनवरी 2022 से 1 जनवरी 2024 के बीच सेवा मुक्त हुए पूर्व सैनिकों को पात्र माना गया था, लेकिन बाद की अधिसूचना में इसे बदल दिया गया, जिससे कई योग्य अभ्यर्थी अपात्र हो गए। राज्य सरकार ने कुल 1226 कांस्टेबल पदों के लिए भर्ती प्रक्रिया शुरू की थी, जिसमें से 123 पद पूर्व सैनिकों के लिए आरक्षित थे।

The Himachal Pradesh High Court has declared the cutoff date set for ex-servicemen in police constable recruitment as illegal and has cancelled it. The court has cancelled the date of discharge (13 December 2022 to 13 December 2024) fixed by the Sainik Welfare Department in its notification dated 21 February 2025 to determine the eligibility of ex-servicemen. A single bench of Justice Jyotsna Rewal Dua has directed to fix a new valid cut-off date for discharge from service within three weeks. The court has also clarified that the result of the ex-servicemen category will not be declared until this process is completed.

The next hearing of the case will be on August 11. The petitioners argued that the date fixed in the notification of February 21 is not mentioned in any law, rule or manual and it appears to be arbitrary. In the earlier notification, ex-servicemen who retired between January 1, 2022 and January 1, 2024 were considered eligible, but this was changed in the subsequent notification, due to which many eligible candidates became ineligible. The state government had started the recruitment process for a total of 1226 constable posts, out of which 123 posts were reserved for ex-servicemen.
